Why Do I Say "No2Probate"?

  • A Will & Trust provide TAX SAVINGS

  • A Will & Trust provide FINANCIAL PRIVACY

Did You Know?

IDon't Throw Your Money Away in Probate !f you do not take the time to make decisions for your future now, the state will make them for you through a very expensive process called Probate.

This can mean horrible results for you, your family and your assets.

Did you know that if you do not have a Will the state will charge your family and heirs excessively high statutory Probate fees for administering your estate and deciding who, if anyone, is entitled to your property after your passing?

Did you know that if you do not have an Advanced Healthcare Directive or Durable Power of Attorney the person you want making your emergency medical and financial decisions might not be the person making the decisions?

Did you know that by quickly and painlessly forming a Family Trust these problems can be solved?

Without proper legal direction, the State will follow the Probate Code in determining who gets your property and the cost to transfer it to them.

A will tells the Court how to distribute the property, but

A WILL STILL REQUIRES PROBATE.

Only a Trust Avoids Probate

HIPAA

A warning for those of you who think HIPAA has no “teeth” and isn’t being enforced: Since the HIPAA privacy rule took effect in April 2003, more than 175 alleged privacy violations have been referred to the Department of Justice for potential criminal prosecution. With nearly 11,000 complaints made during that same time period, there’s no wonder why doctors are becoming far stricter with their HIPAA procedures. Our Estate Planning package is completely HIPAA complaint...No Worries Here!

Q. Why should I have an attorney draw up my estate plan when I can have a paralegal or a typing service do it cheaper?

A. The initial cost should not be the only consideration because a poorly prepared estate plan may eventually prove to be much more costly than a properly prepared estate plan. Problems that were part of the estate plan when it was drawn up may not become apparent until after the person who signed the estate plan has died. At that point it may be too late to correct the problems and the result could be extended and costly litigation. It is also a violation of state law for paralegals to give legal advice. Due to the complexity of a will or trust, questions are bound to arise about the meaning of various parts of the document. Non-lawyers who attempt to answer these questions are breaking the law and could be providing inaccurate information.
